Segundo ele, propostas do tipo devem ser iniciadas pelo Poder Executivo, na medida em que o regime jur\u00eddico dos servidores, que engloba responsabilidades e penalidades disciplinares, \u00e9 de responsabilidade da administra\u00e7\u00e3o municipal, &#8220;constituindo mat\u00e9ria sujeita \u00e0 iniciativa privativa do Chefe do Poder Executivo&#8221;.<\/p>\n<p>O prefeito tamb\u00e9m apontou v\u00edcios de inconstitucionalidade no projeto e nas outras pautas. &#8220;Sua convers\u00e3o em lei revela-se juridicamente invi\u00e1vel diante de v\u00edcios de inconstitucionalidade que comprometem sua validade&#8221;, afirmou.<\/p>\n<p>O Blog do Jamildo diz que tentou contato com o vereador Osmar Ricardo para obter posicionamento oficial do parlamentar, mas ainda n\u00e3o obteve resposta. Quando respondido o site, a mat\u00e9ria ser\u00e1 atualizada.<\/p>\n<p>Quanto ao PL que dispunha sobre ocorr\u00eancias de viol\u00eancia dom\u00e9stica em condom\u00ednios residenciais e comerciais, o prefeito justificou que o texto discorria sobre assunto o qual j\u00e1 possui legisla\u00e7\u00e3o estadual que determina normas sobre: Lei Estadual n\u00ba 16.587, de 10 de junho de 2019.<\/p>\n<p>&#8220;A proposi\u00e7\u00e3o deixa de exercer fun\u00e7\u00e3o meramente complementar e passa a instituir disciplina distinta para os mesmos fatos e destinat\u00e1rios alcan\u00e7ados pela norma estadual&#8230; cria potencial conflito de interpreta\u00e7\u00e3o e aplica\u00e7\u00e3o entre normas incidentes sobre a mesma mat\u00e9ria&#8221;, escreveu Victor.<\/p>\n<p>A ideia que previa novo sistema de t\u00e1xis foi negada pelo prefeito sob a justificativa de que a proposi\u00e7\u00e3o interfere em tema de fun\u00e7\u00e3o do Poder Executivo. <!--more-->&#8220;O projeto cria encargo diretamente vinculado \u00e0 organiza\u00e7\u00e3o de servi\u00e7o de interesse coletivo e estabelece condicionantes que repercutem na utiliza\u00e7\u00e3o e destina\u00e7\u00e3o de espa\u00e7os privados, promovendo disciplina normativa que se relaciona diretamente com os instrumentos de ordenamento territorial, licenciamento urbano e regula\u00e7\u00e3o administrativa j\u00e1 previstos no ordenamento municipal, o que refor\u00e7a a inadequa\u00e7\u00e3o da iniciativa parlamentar para disciplinar mat\u00e9ria que demanda atua\u00e7\u00e3o coordenada e integrada do Poder Executivo&#8221;, defendeu.<\/p>\n<p><strong>Desaven\u00e7as entre o petista e a gest\u00e3o<\/strong><\/p>\n<p>Quando o atual prefeito do Recife ainda era vice na gest\u00e3o de Jo\u00e3o Campos (PSB), Osmar Ricardo, suplente na C\u00e2mara, foi respons\u00e1vel pela \u00faltima assinatura para instaura\u00e7\u00e3o da Comiss\u00e3o Parlamentar de Inqu\u00e9rito contra o socialista.
